Excessive expedited passport fee: Who’s affected?
Did you pay an expedited passport fee when you were renewing or applying for a U.S. passport? Please fill out the form on this page to see if you are eligible to take part in a passport fee class action.
On Oct. 4, 2024, a class action lawsuit was filed against the U.S. Department of State in the Northern District of California, alleging that the State Department has unlawfully overcharged Americans seeking to expedite their passport application or renewals by imposing a $60 expedited processing fee. The plaintiff argues that the State Department is only authorized to charge a fee that reflects the actual cost of providing expedited processing, but that the cost for expedited processing is significantly less than $60. Plaintiff also argues the government has failed to justify the $60 fee as required under the law. The lawsuit seeks to have the fee declared unlawfully excessive and to recover the amounts charged beyond what the law permits.
If you paid expedited passport fees, you may be eligible to join the class action lawsuit and seek compensation for these allegedly unlawful fees.

How much does an expedited passport cost?
Obtaining or renewing a U.S. passport requires paying several fees to the State Department. The standard application fee for a first-time passport or to renew an existing passport is $130. However, for those seeking expedited service, an additional $60 fee is required. This expedited passport fee ensures the passport application or renewal request is processed within a shorter timeframe, currently 2 to 3 weeks. Without this, processing time is currently estimated to last up to 6 weeks.
The $60 expedited passport fee is separate from the 1 to 2 day delivery fee of $21.36, which applicants can also pay, but which is not part of this lawsuit. This separate shipping fee guarantees the passport will arrive within 1 to 2 business days after the U.S. Department of State puts the passport in the mail. The expedited passport service and delivery fees are levied on top of the standard application or renewal fees.
